These Terms of Service ("Terms") govern your access to and use of HotelOil, operated by Reviewstay, LLC ("Hoteloil," "we," "us," or "our"), including hoteloil.com, our web application, APIs, Folio public hotel sites, and related services (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of a hotel, management company, or other organization, you represent that you have authority to bind that organization to these Terms.
The Service is intended for business use by hotel operators, marketing teams, and authorized service providers. You must be at least 18 years old and capable of forming a binding contract. You may not use the Service if you are barred under applicable law or if we have previously suspended or terminated your account for violation of these Terms.
HotelOil provides hotel digital advertising intelligence and related tools, which may include:
Features vary by subscription plan. We may modify, add, or discontinue features with reasonable notice where practicable.
You must provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at reports@hoteloil.com if you suspect unauthorized access.
Team workspaces allow multiple users with role-based permissions. The account owner and workspace administrators are responsible for managing member access.
Paid plans are billed through Stripe on a recurring basis (monthly or annually, as selected). By subscribing, you authorize us and Stripe to charge your payment method for applicable fees, taxes, and renewals until you cancel.
Free trials, promotional pricing, and discounts may be offered at our discretion and are subject to the terms displayed at checkout. Unless stated otherwise, trials convert to paid subscriptions at the end of the trial period if not canceled beforehand.
You may cancel a subscription from your account billing settings. Cancellation stops future charges but does not entitle you to a refund for the current billing period except where required by law or explicitly stated in your plan terms.
If you enroll in HotelOil Autopilot, additional terms—including commission structures, access requirements for advertising platforms, invoicing schedules, and performance metrics—are presented during enrollment and form part of your agreement with us. Autopilot may require you to grant designated HotelOil personnel access to third-party advertising accounts (for example, via pilot@hoteloil.com) solely to manage campaigns on your behalf.
You remain responsible for approving budgets, reviewing performance reports, and ensuring that Autopilot activities comply with your internal policies and applicable platform rules.
You retain ownership of hotel data, uploaded files, Folio site content, and other materials you submit to the Service ("Customer Content"). You grant HotelOil a limited license to host, process, display, and transmit Customer Content solely to provide and improve the Service, including generating analytics, reports, public Folio pages, and social posts you authorize.
You represent that you have all rights necessary to submit Customer Content and that its use through the Service does not violate any law or third-party rights.
You agree not to:
We may investigate violations and suspend or terminate access where necessary to protect the Service and other users.
The Service may connect to third-party platforms (such as Expedia, Booking.com, Koddi, Meta, X, LinkedIn, Google, Microsoft, Slack, and Stripe). Your use of those platforms is governed by their own terms and policies. HotelOil is not responsible for third-party services, outages, policy changes, or data accuracy on external platforms.
When you authorize publishing or notifications through connected platforms, you are responsible for the content published and for complying with each platform's advertising, disclosure, and content rules.
We may disclose account data where required by valid legal process from a public authority, such as a subpoena, court order, or warrant. We review the legality of each request, challenge requests we consider unlawful, disclose only the minimum information necessary, and document each request and our response, as described in our Privacy Policy.
HotelOil and its licensors own the Service, including software, design, documentation, trademarks, and proprietary analytics methodologies. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as permitted here.
Feedback you provide may be used by us without restriction or compensation.
Each party may receive non-public information from the other. You agree to protect HotelOil's confidential information and to use it only as needed to use the Service. We treat your non-public hotel data as confidential and disclose it only as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOTELOIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Analytics, forecasts, pace reports, and Autopilot recommendations are informational tools. They do not guarantee specific advertising outcomes, revenue, or return on ad spend. You are responsible for business decisions based on Service output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEWSTAY, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO HOTELOIL IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold harmless Reviewstay, LLC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Service, your violation of these Terms, or your violation of any third-party rights or platform policies.
You may stop using the Service and cancel subscriptions at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay applicable fees, or if continued provision poses legal or security risk.
Upon termination, your right to access the Service ends. Provisions that by their nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction apply.
Except where prohibited by law, disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. Material changes may also be communicated by email or in-app notice where appropriate.
